A lawyer who claims she was sexually harassed by former Gov. Donald DiFrancesco and fired from his law firm when she "blew the whistle" on bad behavior by a municipal judge filed suit against the firm yesterday.
DiFrancesco called the allegations "absolutely false."
The civil suit was filed in Essex County by Michele D'Onofrio, 48, a single mother of four who lives in Warren Township and served as its municipal prosecutor. She claims she was fired last month "in retaliation" for filing a judicial ethics complaint against a local judge after being warned not to do so.
The lawsuit says D'Onofrio had learned that Warren Township Municipal Court Judge Richard Sasso was "inebriated" on the bench and had abused his powers. It claims Assemblyman Christopher "Kip" Bateman (R-Somerset), a partner in the firm, warned her not to file a complaint.
D'Onofrio contends that during her six years at the firm, she was "regularly subjected to unwelcome and sexist comments and advances by Donald DiFrancesco" and "experienced a pattern and practice of sex discrimination."
Reached last evening, DiFrancesco, 62, said: "Let me just say this: Kip and I are public figures so we're easy targets. This person was asked to take her business elsewhere -- not just by me, but by the owners of our business for business reasons. What she's alleging is absolutely false, both as to myself and as to Kip. It's just a matter of trying to collect."
Efforts to reach Sasso last evening were unsuccessful.
The lawsuit alleges that at a meeting of the League of Municipalities in Atlantic City, "DiFrancesco asked plaintiff to stay an extra night in his suite and to attend a Beach Boys concert with him. Plaintiff refused."
DiFrancesco said his wife, Diane, was with him at the Atlantic City convention and he was only trying to be nice by offering D'Onofrio and his other partners the chance to use an extra room in their suite.
He declined to comment on any of the other accusations, on the advice of his attorney.
The lawsuit also claims that shortly before D'Onofrio underwent reconstructive surgery this month following a double mastectomy, DiFrancesco made inappropriate remarks about how she would look afterward.
It also alleges the firm has no female partners and recently held a golf outing for male employees only.
"It's 2007. Who has a men-only firm outing? You kidding me?" said Nancy Erika Smith, the Montclair lawyer who is representing D'Onofrio.
"Other women have complained about the conduct and I can prove it," Smith said. "Once in a while, you get these big shots who think that this little girl, who is nobody, can't stand up to them. That's how they treated her. It's been awful."
Smith said she filed the lawsuit in Essex County because D'Onofrio had brought her concerns to some Superior Court judges in Somerset County who "are going to be witnesses."

Having read your letter dated June 5, 2007, I am convinced that you and the Detective who reviewed the information provided by the Somerset County Prosecutor’s Office and myself, have selectively concluded not to prosecute for political quid pro quo reasons, this opinion is based upon what was told to me concerning Mr. Franco’s boasting about his alignment with judges. It is evident that a crime took place and since you have chosen not to prosecute, you must have a reason, other than an intelligible and legal standing one.
The evidence provided was crystal clear that Mrs. Franco without any equivocation signed the back of the check, which was admitted by Mr. Franco himself, on an audiotape that was provided to you. There were two certified documents that confirmed that Mr. Franco was pilfering money that was meant for me, in addition to a clearly altered check and other evidence.
Since your Office has no embarrassment to align itself with the Somerset County Prosecutor’s Office, I will have no qualms about exposing your glaring lack of sincerity and diligence along with exposing factors that are taking place in Somerset County.
To sum this matter up, I am disgusted and appalled with the indecent behavior from your Office and Somerset County.
Instead of restoring the connotation people have about New Jersey and attempting to correct rampant thugs and override selective law enforcement, you people contribute to it.
It’s actions like yours that have turned this state into the target of laughter across the nation. It’s a shameful reputation that has been created and as long as individuals like you are left in control, this system has no future.
Sometimes justice takes a bit longer to be served. This matter will be snowballing and collecting all those people that have participated in knowing that Mr. and Mrs. Robert Franco, Esq. have participated in successfully pulling off a theft. Your office, along with the Somerset County Prosecutor’s Office aided and abetted a criminal act. If you did listen to the tape recording of Mr. Franco, what would you do if I said to you, “I want to take my little finger, put it on the trigger and bury you”, would you prosecute me, Mr. Cannon?

Heating up and Boyle ing over SOMERSET COUNTY

Dear Detective Burke,
I added a little more information this morning concerning Marie and Philip Crosby and their case before Judge Gasiorowski.
Marie is a friend of mine and involved me through the steps of her brief trial. I worked with her on the investigation with Charolotte Gaal and the SCI’s investigation into builder and township officials.
Marie had called me on my cell phone crying that Judge Gasiorowski let the township officials out of the case and she felt that her attorney, Frank DeGiovanni was covering up something and did not dispute this dismissal. I came to learn that the Official William Boyle is former Judge John M. Boyle’s son.
Please trace the steps between Judge Gasiorowski, William Boyle, Frank DeGiovanni (no docket numbers) and now the latest case of more building officials.
What’s most interesting is, Robert Franco allegedly sent a letter to the FBI exposing this issue of docket numbers, I wonder if he ever sent it.
I went on www.CRRoL.org this morning to print out the entire article about Judge Gasiorowski letting the Officials out and found that part of the newspaper story was removed.
This is not the first time CRRoL. was hacked.
XXXXXXXX another litigant is now living in a Basking Ridge apartment owned by a former police officer from Plainfield, Judge Gasiorowski had some involvement in helping the owner in their court matter. XXXXXXX has no heat operating as of this time.

I am providing this information for your review.
A few other people also have information to pass on to you concerning Judge Gasiorowaski but I have not provided your name. I will, at your request.
I was directed to contact you by Deputy Prosecutor Kolodzieski on January 25, 2007. I had attempted on my own to make a complaint to the Bridgewater Police Department several months ago concerning the Sheriffs’ Department but the Police Officer rejected my complaint.
We, the complainants did however plan to bring attention to our issues but I thought in light of my matter with Robert Franco, Esq. along with the veiled threats and accusation Mr. Franco was sending out, that this information might be better reported down the road. I reconsidered since there has been information and stories about Judge Gasiorowaski reported, hopefully this is an appropriate time.
The initial question arouse when one of my attorneys, Ephraim Jerchower, who represented me with the Villas on the Park Matter, was awarded a fee via the Fee Arbitration Committee despite he signed a retainer for a contingent fee. He terminated the representation and should not have been awarded anything. (Exhibit A).
On May 18, 1989, Mr. Jerchower was awarded, contrary to the laws of arbitration, a fee of $13,128 (Exhibit B). Inclusive of this exhibit presented, is the rule why no fee should be awarded. This is simply the backdrop and at this point moot, but issues of why and how lend itself to the heart of the corruption regarding Somerset County and Judge Gasiorowski.
Fast Forward to Judge Gasiorowski
June 3, 2005
On June 3, 2005, Judge Gasiorowask awarded Mr. Jerchower, $13,129, then amended the amount by adding interest to the “fee judgment” on June 6, 2005 totaling $16,722 putting the claim out of the Special Civil Court ( Exhibit C). Special Civil hears cases ceiling at $15,000. Please note, no address was provided for me the defendant on the court form.
Mr. Jerchower filed his complaint six years after the fee award was issued and one day before the statue of limitation ended. The key issue is, I was never “noticed” that I was being sued. Mr. Jerchower never provided my address. The Court mailed out a post card to only Mr. Jerchower, on May 17, 2005
( Exhibit D) (See all post cards with improper address) that stated that a post card was mailed to me on May 19, 2005, that is impossible and ridiculous. I filed several motions each and every one was denied. Judge Gasioroski favored the attorney. You can see with my speedy response dated June 13, 2005 I provided my proper address but the court refused to use it. I was very suspect of one of the court intake persons at the filing counter. (Exhibit E).
In September, I filed a motion to have the matter transferred to the proper court, I hired a process server to file and somehow with the assistance of the intake clerks my filings became lost and ended up in the Sheriff’s Office. (Exhibit F).
On November 8, 2005, Mr. Jerchower and I entered into a settlement. I went on a payment plan and satisfied our agreement.
In March of 2006, while I was employed in a very stressful position, I had gotten several letters from Bank of America informing me that I was bouncing checks. I got a printout of my account and saw the “Court” along with the Sheriff’s Office was responsible for REMOVING every cent that I had on
March 8, 2005 (Exhibit G).
About ten days later, I received a letter dated March 16, 2005 stating a levy was placed on my account, not stating the truth, that my funds were removed. In addition to the Sheriff’s Office violating the Federal statue, I was entitled to retain a $1,000 of which was Unemployment Funds but instead, every cent was removed. (Exhibit H).
I called the Court Officer, William De Guillo in a panic and he agreed to return my funds after I paid him unrecorded fees of $657.32. I was unable to leave work but a friend Steven Fine took the cash that I had to advance from a credit card in order to give Mr. DiGuillo the “cash” he demanded. (Exhibit I). Mr. De Guillo would not give Mr. Fine a receipt but after much demand he signed the note that I had typed up, See (Exhibit J).
Mr. Jerchower, now feeling badly for me, took immediate efforts to have my funds returned because I was bouncing checks and my mortgage was on a automatic debit account. (Exhibit K).
Mr. De Guillo went back to business as usual and asked the bank to remove the levy on April 5, 2006 but he had never advised Mr. Jerchower the rightful but satisfied creditor that the money had been removed for him. It was simply a case that I had caught it due to bouncing checks. (Exhibit L).

The initial question arouse when one of my attorneys, Ephraim Jerchower, who represented me with the Villas on the Park Matter, was awarded a fee via the Fee Arbitration Committee despite he signed a retainer for a contingent fee. He terminated the representation and should not have been awarded anything. (Exhibit A).
On May 18, 1989, Mr. Jerchower was awarded, contrary to the laws of arbitration, a fee of $13,128 (Exhibit B). Inclusive of this exhibit presented, is the rule why no fee should be awarded. This is simply the backdrop and at this point moot, but issues of why and how lend itself to the heart of the corruption regarding Somerset County and Judge Gasiorowski.
Fast Forward to Judge Gasiorowski
June 3, 2005
On June 3, 2005, Judge Gasiorowask awarded Mr. Jerchower, $13,129, then amended the amount by adding interest to the “fee judgment” on June 6, 2005 totaling $16,722 putting the claim out of the Special Civil Court ( Exhibit C). Special Civil hears cases ceiling at $15,000. Please note, no address was provided for me the defendant on the court form.
Mr. Jerchower filed his complaint six years after the fee award was issued and one day before the statue of limitation ended. The key issue is, I was never “noticed” that I was being sued. Mr. Jerchower never provided my address. The Court mailed out a post card to only Mr. Jerchower, on May 17, 2005
( Exhibit D) (See all post cards with improper address) that stated that a post card was mailed to me on May 19, 2005, that is impossible and ridiculous. I filed several motions each and every one was denied. Judge Gasioroski favored the attorney. You can see with my speedy response dated June 13, 2005 I provided my proper address but the court refused to use it. I was very suspect of one of the court intake persons at the filing counter. (Exhibit E).
In September, I filed a motion to have the matter transferred to the proper court, I hired a process server to file and somehow with the assistance of the intake clerks my filings became lost and ended up in the Sheriff’s Office. (Exhibit F).
On November 8, 2005, Mr. Jerchower and I entered into a settlement. I went on a payment plan and satisfied our agreement.
In March of 2006, while I was employed in a very stressful position, I had gotten several letters from Bank of America informing me that I was bouncing checks. I got a printout of my account and saw the “Court” along with the Sheriff’s Office was responsible for REMOVING every cent that I had on
March 8, 2005 (Exhibit G).
About ten days later, I received a letter dated March 16, 2005 stating a levy was placed on my account, not stating the truth, that my funds were removed. In addition to the Sheriff’s Office violating the Federal statue, I was entitled to retain a $1,000 of which was Unemployment Funds but instead, every cent was removed. (Exhibit H).
I called the Court Officer, William De Guillo in a panic and he agreed to return my funds after I paid him unrecorded fees of $657.32. I was unable to leave work but a friend Steven Fine took the cash that I had to advance from a credit card in order to give Mr. DiGuillo the “cash” he demanded. (Exhibit I). Mr. De Guillo would not give Mr. Fine a receipt but after much demand he signed the note that I had typed up, See (Exhibit J).
Mr. Jerchower, now feeling badly for me, took immediate efforts to have my funds returned because I was bouncing checks and my mortgage was on a automatic debit account. (Exhibit K).
Mr. De Guillo went back to business as usual and asked the bank to remove the levy on April 5, 2006 but he had never advised Mr. Jerchower the rightful but satisfied creditor that the money had been removed for him. It was simply a case that I had caught it due to bouncing checks. (Exhibit L).

I must apologize that I cannot comply with your request to send my information in by certified mail, but having been the Victim of two thefts that your Assistant Prosecutor does not believe warrants a prosecution, I cannot afford to send crucial information which I know your Office so diligently would want, in order to make your efforts easier. The residents of Somerset County would like to move forward and be comfortable that individuals who are ill effecting the decent tax payers of Somerset County, will be prosecuted. I will continue to help you enforce laws and hopefully, you will similarly accept other's information through this venue as well. I know certainly and respectfully, Wayne Forrest does not want Crime in Somerset County.
The Letter dated June 1, 2001 from Mr. Franco is the first/ only credible statement that I have seen from Mr. Robert Franco, although your Assistant Prosecutor must not believe that he altered the check below, or else he would be prosecuting. I know your Office has great respect for him and according to him, has your Office handled, thus you must take the enclosed information seriously and move forward with his respected opinion, concerning Federal Offenses. Obviously, Mr. Franco is above or very knowledgeable around the Law and has a great recognition of what is legal and what is not, similar to your Office.
Please heed the contents of the letter dated June 1, 2001 from Robert Franco and take the appropriate steps to stop the crime in New Jersey.
